Account Deletion & Data Erasure Policy

1. Legal Basis

This Account Deletion & Data Erasure Policy ("Policy") is issued and maintained by FirgoMart in accordance with applicable laws and regulations of India, including but not limited to:

• Digital Personal Data Protection Act, 2023;
• Information Technology Act, 2000;
• Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021;
• Consumer Protection (E-Commerce) Rules, 2020;
• Goods and Services Tax Act, 2017;
• Applicable Income Tax Laws of India.

For users accessing FirgoMart services from outside India, this Policy is implemented in alignment with internationally recognized data protection principles, including GDPR standards where applicable.

2. Scope and Applicability

This Policy applies to:

• Buyers and Customers;
• Sellers, Vendors, and Merchants;
• International users accessing the FirgoMart Platform.

This Policy governs the procedure for requesting account deletion and explains how associated personal data is processed, erased, retained, or protected in accordance with applicable legal requirements.

3. Right to Request Account Deletion

In accordance with applicable data protection laws, users have the right to:

• Withdraw previously granted consent;
• Request deletion of personal data associated with their account;
• Seek grievance redressal regarding data processing activities.

Methods to Request Account Deletion

Users may submit an account deletion request through any of the following methods:

Option 1 – Through Website or Mobile Application

1. Login to your FirgoMart account.
2. Navigate to Profile Settings.
3. Select "Delete Account".
4. Complete OTP or email verification.
5. Submit the deletion request.

Option 2 – Through Email

Users may send a deletion request from their registered email address to: support@firgomart.com

For security and fraud prevention purposes, FirgoMart reserves the right to verify the identity of the requesting user before processing any deletion request.

4. Account Deletion Process and Timeline

4.1 Request Submission

The deletion request shall be recorded on the date it is received by FirgoMart ("Day 0").

4.2 Identity Verification

Within forty-eight (48) hours of receiving the request, FirgoMart may verify the identity of the user through OTP authentication, email confirmation, or supporting documentation where necessary.

4.3 Account Deactivation

Upon successful verification, the account shall be immediately deactivated and inaccessible for normal use.

4.4 Permanent Deletion

Subject to applicable legal and regulatory retention obligations, personal data associated with the account shall be permanently deleted within seven (7) calendar days from successful verification. Users shall receive confirmation of receipt of the deletion request and final confirmation once the deletion process has been completed.

5. Data Subject to Deletion

Subject to statutory exceptions and legal retention requirements, the following information shall be permanently deleted:

• Profile information;
• Contact details;
• Login credentials and authentication data;
• Saved addresses;
• Wishlist information;
• Shopping cart information;
• Marketing and communication preferences;
• Uploaded non-financial documents;
• Account settings and preferences.

6. Data Retained for Legal and Regulatory Purposes

Notwithstanding any account deletion request, FirgoMart may retain certain information where required by law.

6.1 Financial and Tax Records

In compliance with applicable GST, taxation, accounting, and financial regulations, FirgoMart may retain: tax invoices; transaction history; payment records; settlement records; seller commission records; and accounting and audit records. Such records may be retained for the period required by applicable law, generally between six (6) and eight (8) years or such longer period as may be legally required.

6.2 Legal, Security, and Regulatory Compliance

FirgoMart may retain information where necessary for: fraud prevention and detection; security investigations; chargeback and payment disputes; enforcement of contractual obligations; compliance with court orders; government or regulatory authority requests; and protection of platform integrity and user safety.

Any retained information shall be securely stored, not used for marketing purposes, and accessible only to authorized personnel with a legitimate business or legal need.

7. Seller-Specific Conditions

Seller accounts may only be permanently deleted upon fulfillment of all applicable obligations, including:

• Completion of pending orders;
• Settlement of customer refunds and returns;
• Clearance of outstanding platform fees, charges, or commissions;
• Resolution of active disputes or claims;
• Compliance with GST, tax, and other statutory filing obligations.

FirgoMart reserves the right to defer permanent deletion of seller accounts until all contractual, financial, and regulatory obligations have been fulfilled.

8. International Users

• Account deletion requests shall be processed in accordance with applicable Indian laws and regulations.
• Where GDPR or equivalent regulations apply, requests shall be handled in accordance with recognized Right to Erasure principles.
• Cross-border data transfers shall be conducted in accordance with applicable legal requirements and government notifications.

9. Grounds for Refusal or Delay

FirgoMart may refuse, suspend, or delay account deletion where:

• Retention is required by applicable law;
• Required by a government authority or regulatory body;
• Necessary for dispute resolution;
• Necessary to enforce legal or contractual rights;
• Required to investigate fraud, abuse, or security incidents;
• Necessary to protect platform integrity and public safety.

Where deletion cannot be completed immediately due to legal requirements, users shall be informed accordingly.

10. Grievance Redressal Mechanism

In compliance with applicable Indian laws and regulations:

• Complaints shall be acknowledged within forty-eight (48) hours of receipt.
• Reasonable efforts shall be made to resolve complaints within fifteen (15) days.

11. Policy Updates and Amendments
